Terms of Service

These terms govern your use of MagicMeme at magicmeme.com, including the template catalog, AI studio, face-swap tools, credits, and agent payment endpoints. By using the service you agree to them.
The service
MagicMeme helps you caption meme templates, generate AI variants, swap a face onto a template, and download a PNG. Catalog browsing, the classic editor, and watermark-free PNG downloads of captioned templates are free. Paid features use credits or a one-time agent charge. See Pricing.
Accounts
Sign-in is passwordless email OTP. You are responsible for the inbox you use. We may suspend an account that we reasonably believe is abusing the service, violating these terms, or creating legal risk.
Credits and agent payments
Credit packs are prepaid digital units for original images, face reference / face swap, background removal, and video. Credits are not cash, are not transferable, and expire only if we give notice. Agents may pay per face-swap through Stripe Machine Payments instead of credits. Refunds are described in the Refund and Return Policy.
Your content
You keep the captions you write. You grant MagicMeme a license to process uploads (including face photos) and generated files so we can run the product: generate, store in your library, and show them back to you. Face and reference outputs stay private and cannot be published as public remix links.
You must have the right to upload a photo and to use any likeness in it. Do not upload a face without consent from the person depicted (or a lawful basis). You are responsible for how you share finished memes.
Templates and third-party images
Template photos often come from the internet and may be subject to copyright or publicity rights. We do not grant you a license to the underlying photograph. You own your captions. Clear rights yourself before commercial use.
Acceptable use
Do not use MagicMeme to:
- Create or share sexual content involving minors
- Commit fraud, impersonate someone to cause harm, or break the law
- Attack, scrape, or overload the service
- Bypass payment, credits, or access controls
AI providers
Generation is fulfilled through third-party models (for example via OpenRouter). Outputs can be wrong, blocked, or stylistically off. We do not warrant that a generation will succeed or match a reference exactly.
Disclaimer and liability
The service is provided “as is.” To the fullest extent allowed by law, MagicMeme is not liable for indirect, incidental, or consequential damages, or for losses above the amount you paid us in the 12 months before the claim.

Changes
We may update these terms. Continued use after the effective date on this page means you accept the update. Contact hello@magicmeme.com.
