Terms of Service

These terms govern your use of MagicMeme at magicmeme.com, including the template catalog, the meme editor, and the GIF maker. By using the service you agree to them.
The service
MagicMeme helps you caption meme templates, make GIFs, and download a PNG or GIF. The service is free and does not need an account.
Age
You must be at least 13 to use MagicMeme.
Your content
You keep the captions you write and the rights you already hold in files you upload. You grant MagicMeme a license to host, reproduce, and modify those files and the images we generate from them so we can run the product: render your memes and GIFs and show them back to you. This license lasts while we need it to operate the service, including backups.
By uploading a photo, video, or other file, or by pasting a URL into a tool, you represent that you have the rights to use and modify it, that the upload does not infringe anyone else’s rights, and that you have consent from any person depicted (or another lawful basis). You are responsible for how you share finished memes.
Templates and third-party images
Using MagicMeme does not give you ownership of the software, the MagicMeme name, or the template images. Template photos often come from the internet and may be subject to copyright or publicity rights. We do not grant you a license to the underlying photograph. You own your captions. Clear rights yourself before commercial use.
Some catalog images are not ours. The person who made an image available is responsible for it. We may review content, and we may remove or refuse anything we reasonably believe breaks these terms or the law. We do not promise to review the catalog before it is published.
Copyright notices
We respond to notices of alleged copyright infringement and may suspend users who repeatedly infringe. To ask for a takedown, use the removal request or email hello@magicmeme.com with the page or file URL, a description of the work, and how to reach you. Taking a page down does not, by itself, decide who owns the image.
Acceptable use
Do not use MagicMeme to:
- Create or share sexual content involving minors
- Commit fraud, impersonate someone to cause harm, or break the law
- Attack, scrape, or overload the service
- Bypass rate limits or access controls
Disclaimer and liability
The service is provided “as is.” To the fullest extent allowed by law, MagicMeme is not liable for indirect, incidental, or consequential damages, or for losses above the amount you paid us in the 12 months before the claim.
You will cover claims, damages, and reasonable legal fees that arise from your uploads, captions, finished memes, or a breach of these terms, including a claim that your content infringes someone else’s rights.

Changes
